Terms and Conditions for Pinewoods Technology Services FZE Hereinto after refereed as “Oto Mobility” or “Company” offering Chauffeur Services in UAE

Definition:

  1. Booking Platform: The system used by Company to facilitate bookings between customers and third-party service providers.
  2. Chauffeur Services: A service involving the provision of a professional driver to transport passengers in a vehicle for a specified duration or destination, arranged through a booking platform.
  3. Airport Transfer: A pre-arranged transportation service to and from an airport, provided by a third-party service provider, involving a chauffeur-driven vehicle.
  4. Intercity Rides: A transportation service between two or more cities, provided by a chauffeur-driven vehicle, arranged through a booking platform for intercity travel
  5. Third-party Service Provider: Any individual or entity providing chauffeur services via Company's platform.
  6. Service Fulfillment: The delivery of transportation services by the third-party provider, including vehicle and chauffeur quality.
  7. Reservation: A customer’s formal request to book chauffeur services, creating a binding contract once confirmed.
  8. Modification Requests: Customer requests to change booking details, subject to approval and potential additional charges.
  9. Booking Confirmation: The official acknowledgment from Company that a customer’s reservation is confirmed.
  10. Cancellation Terms: The conditions under which a customer can cancel a booking and the applicable refund policy.
  11. Refunds: The return of payment following a cancellation, according to the established terms.
  12. No-Show: A customer’s failure to appear for a booked service, resulting in a full charge.
  13. Pricing: The cost for services, set by the provider, which may include additional fees like waiting times or tolls.
  14. Surcharges: Additional fees applied to the service cost, disclosed to customers before booking confirmation.
  15. Customer Responsibilities:The obligations of customers to follow laws, provide accurate information, and safeguard personal property.
  16. Damage Liability: The customer’s responsibility to cover costs for any damage to the vehicle caused during service.
  17. Lost or Misplaced Items: Personal belongings left behind during service, for which Company assumes no responsibility.
  18. Booking Facilitation: Company’s role in enabling bookings and processing payments, without responsibility for service delivery.
  19. Dispute Mediation: Company’s role in relaying customer concerns to service providers, without resolving disputes.
  20. Data Protection Laws: Legal requirements for handling personal data, ensuring privacy and security during the booking process.
  21. Customer Support: Assistance provided by Company for booking inquiries and payment-related issues.
  22. Disclaimer of Liability: A statement limiting Company’s responsibility for service issues, which are the service provider’s responsibility.
  23. Force Majeure: Circumstances beyond control (e.g., natural disasters, government regulations, acts of god) that prevent or delay service delivery, exempting liability.
  24. Modification of Terms: Company’s right to update the Terms and Conditions, with continued use indicating acceptance of changes.

1. Introduction

  • These Terms and Conditions govern the booking of chauffeur services facilitated by Pinewoods Technology Services FZE, hereinafter referred to as “Oto Mobility” or “Company,” in the United Arab Emirates (UAE). Company operates solely as a booking and payment facilitation platform, connecting customers with third-party service providers for chauffeur services, airport transfers, and intercity rides. By making a reservation, users acknowledge and agree to these terms.

2. Service Overview

  • Company provides a booking service for various transportation needs, including chauffeur-driven vehicles, airport transfers, and intercity rides through its call center. All bookings are processed by Company and forwarded to the respective third-party service provider. Company does not own or operate any vehicles, nor does it employ chauffeurs. The responsibility for service fulfillment, including vehicle condition and driver conduct, lies entirely with the service provider.

3. Booking and Modifications

  • All reservations must be made through the Company call center.
  • Customers must provide accurate booking details, including pickup location, time, and any special requirements.
  • Any modification requests, including changes to time, location, or vehicle type, must also be made via the call center and are subject to approval by the service provider.
  • Modifications may be subject to additional charges, which will be communicated to the customer before confirmation.
  • Bookings are subject to availability, and confirmation will be provided via email or SMS.

4. Cancellation and Refund Policy

Customers may cancel bookings under the following terms:

  • 48 hours before service: 75% refund.
  • 24 hours before service:50% refund.
  • 12 hours or less before service: No refund.
  • No-shows: No Refund Applicable.

Refunds will be processed to the original payment method in 5 days , with final crediting subject to the customer’s bank processing times. Any applicable transaction fees or Foreign exchange charges are non-refundable.

5. Pricing and Payment

  • Pricing is determined by the service provider and may vary based on demand, time of booking, and vehicle type.
  • Customers are charged for actual usage, including any additional costs such as waiting time, extra stops, tolls(If applicable) , and parking fees.
  • Payments are collected by Company on behalf of the service provider and transferred to the respective supplier.
  • Extension rates will vary based on the date and duration of the required extension. Any applicable surcharges will be communicated to the customer prior to booking confirmation.

6. Service Standards and Customer Responsibilities

  • Customers must ensure compliance with all local regulations while using the service.
  • Any damage to the vehicle caused by the customer’s actions may result in additional charges, which will be recovered from the customer after the completion of the rental.
  • Company is not responsible for lost or misplaced personal belongings; customers must secure their items during the journey.
  • For airport transfers, customers must provide accurate flight details to ensure timely pickup.

7. Rule of Company

  • Company’s role is strictly limited to booking facilitation, payment processing, and forwarding service requests to the supplier.
  • Company does not mediate disputes between customers and service providers but may assist in relaying concerns to the supplier for resolution.
  • Company is not responsible for delays due to traffic, weather conditions, or other unforeseen circumstances affecting service providers.

8. Data Privacy and Security

  • Personal information is collected and processed in compliance with UAE data protection laws.
  • Customer data is used solely for booking management and payment processing and will not be shared with third parties except as required to fulfill the service.
  • Payments are processed through secure online payment gateways.

9. Support and Assistance

  • For new bookings and modifications , customers must contact 04 5733 533.
  • For service-related inquiries, customers must directly coordinate with the assigned service provider.
  • Urgent concerns can be reported through the contact number provided in the booking confirmation email.

10. Liability Disclaimer

  • Company is not liable for delays, cancellations, or issues arising from service provider performance.
  • Customers acknowledge that Company serves as a facilitator and bears no responsibility for any disputes or claims related to service execution.
  • Any disputes regarding service fulfillment must be addressed directly with the third-party provider.

11. Amendments to Terms and Conditions

  • Company reserves the right to update these terms at any time without prior notice.
  • Continued use of the service after updates implies acceptance of the revised terms.
  • Customers are encouraged to review these terms periodically for any changes..
